2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 351(2), 115(2), 118(1), 117(2), 109, 303(2), 76 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, when mother of informant was cooking food, in the meantime, all the FIR named accused persons including this petitioner reached there and assaulted the informant side by means of knife, lalthi, danda, rod etc.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is land dispute between the parties and Title Suit No. 207 of 2017 is pending between them in Civil Court, Ara. Present case is counter blast of Complaint Case No.
Patna High Court CR. MISC. No.49547 of 2025(2) dt.06-08-2025 2/2 507/2025. Doctor has found simple injury.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Bhojpur at Ara in Ara Mufassil Police Station Case No. 92 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
