JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

The petitioner wants to renew the prayer for prearrest bail, which has been dismissed as withdrawn on the ground that earlier the learned counsel under mis-conception without due instructions by the petitioner made prayer to withdraw the prayer of pre-arrest bail. The petitioner is ready to pay back the alleged money not in one instalment rather in six instalments within a period of one year.

The learned counsel for the petitioner submits that the petitioner without admitting the claim is ready to deposit the said amount.

Earlier prayer for pre-arrest bail was dismissed as withdrawn vide order dated 28.01.2015 passed in Criminal

Patna High Court Cr.Misc. No.12356 of 2015 (2) dt.25-03-2015 Miscellaneous No.30933 of 2014 as the learned counsel has prayed to withdraw the same with liberty to seek regular bail. Now, under the changed circumstances, the petitioner wants to pay back the amount of Rs. 2, 62, 532/- in easy instalment within one year.

Under the changed circumstances, in case, the petitioner deposits the alleged amount of Rs. 2, 62, 532/- in four equal instalments not in six instalments as prayed within six months and the first equal instalment must be paid within one month through bank draft in the name of the informant then the petitioner may be released on provisional bail on execution of bail bond to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. Case No. 292/2013 and after deposit of the full amount in six months, the provisional bail granted to the petitioner will be confirmed, and accordingly this Criminal Miscellaneous is, hereby disposed of.
