JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2019 The present application has been filed for modification of order dated 30.04.2018 passed in Cr. Misc. No. 23901 of 2018 to the extent of extending the period of surrender.
The petitioners preferred Cr. Misc. No. 23901 of 2018
Patna High Court CR. MISC. No.45903 of 2019(2) dt.31-07-2019 2/2 with a prayer for anticipatory bail in connection with Ramgarhwa P.S. Case No. 135 of 2003, registered for the offences punishable under Sections 341, 324, 307 and 427/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioners were directed to surrender within twelve weeks but it is submitted by learned counsel for the petitioners that due to some communication gap the order could not be communicated. In the circumstances, the period of surrender is extended by three weeks from the date receipt/production of a copy of this order in connection with Ramgarhwa P.S. Case No. 135 of 2003, pending in the Court of learned SDJM, Raxaul at Motihari.
The order dated 30.04.2018 is modified to the extent indicated above.
Accordingly, this modification application stands disposed of.
