The petitioner apprehends his arrest in a case under Sections 409/420 of the Indian Penal Code.

The allegation against the petitioner is that he being the Incharge Headmaster of Kasturba Gandhi Girls High School, Meghauna withdrew more than 12 lacs and did not submit utility certificate. It is submitted that the petitioner was the Incharge Headmaster since 22.04.2014 to 22.12.2014 and withdrew only Rs. 6,71,600/-. The petitioner vide Anneuxre-2 submitted the utility certificate and, on such, the suspension of the petitioner was revoked.

Considering the facts aforesaid and the fact that the petitioner has already filed utility certificate, the above named petitioner, in the event of his arrest or surrender before the learned

Patna High Court Cr.Misc. No.15370 of 2016 (2) dt.26-04-2016 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Alauli P.S. Case No. 151/2015, G.R. No. 1692/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
