The petitioner, in the present case, is seeking regular bail in connection with Kochas P.S. Case No. 45 of 2018, registered for the offences alleged under Section 366 (A) / 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the victim girl has made statement U/s 164 Cr.P.C. as contained in annexure - 3 of the present application, wherein she has categorically stated that she is aged about 19 years and she was thrown out of her house by her father. She has stated that this petitioner is her husband and he has been falsely implicated by her father along with other family members. The victim girl has narrated as to how her father has been trying to insist her to marry some other person. She has also stated that she would not like to stay with her parents. Considering the facts and circumstances of the case, wherein it appears from perusal of the statement of the victim girl that she has not only disclosed her age about 19 years but has also narrated as to how she has been treated by her father and has categorically stated about her marriage and is willing to stay with the petitioner, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Sasaram, Rohtas in connection with Kochas P.S.
