Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Ben P.S. Case No. 99 of 2017 for the offence under section 30, 30(a), 35(a) and 35(b) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that other co-accused have been granted bail by different benches of this court in Cr. Misc. No. 54290 of 2017, Cr. Misc. No. 8743 of 2018, Cr. Misc. No. 12070 of 2018 and Cr. Misc. No. 25441 of 2018 vide order dated 20.11.2017, 21.02.2018, 28.2.2018

Patna High Court Cr.Misc. No.32601 of 2018(2) dt.06-06-2018 2/2 and 2.5.2018 respectively.

Considering the fact that the petitioner has no criminal antecedent and similarly circumstanced other co-accused have been granted bail, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Addl. District and Sessions Judge cum Special Judge, Excise, Nalanda at Biharsharif, in connection with Ben P.S. Case No. 99 of 2017.
