JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 28-02-2017 By order dated 22.09.2014, learned Principal Judge, Family Court, Sitamarhi had allowed maintenance allowance of Rs. 4000/- per month in favour of Opposite Party No. 2 in exercise of power under Section 125(1) of the Code of Criminal Procedure, 1973. The said order is under challenge in the present criminal revision application.

Learned counsel for the petitioner has pointed out that subsequent to passing of the said order, this Court in Miscellaneous Appeal No. 678 of 2014, has allowed decree for dissolution of marriage between the petitioner and Opposite Party No. 2, and has granted permanent alimony of Rs. 11 Lakhs which will include the arrears of maintenance and the amount of maintenance already paid to

This application has apparently become infructuous and is, accordingly, dismissed. The payment of maintenance shall be governed by the final order passed in Miscellaneous Appeal No. 678 of 2014.
