JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-06-2018 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner, in the present case, is seeking regular bail in connection with Tariyani P.S. Case No.7 of 2018, registered for offences alleged under Sections 392 and 411 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R and the looted article has not been recovered from his possession. The petitioner has no criminal antecedents. It is submitted that till date no T.I.P. has been conducted to establish the identity of the petitioner to the alleged occurrence.

Learned A.P.P for the State is present.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.32482 of 2018 (2) dt.13-06-2018 2 /2 that the petitioner is not named in the F.I.R and the looted article has not been recovered from his possession and also that he has no criminal antecedents, let the petitioner, named above, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sheohar, in connection with Tariyani P.S. Case No.7 of 2018 subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
