The present application has been filed for modification of the order dated 10.11.2015 passed in Cr. Misc. No. 42639 of 2015. The learned counsel for the petitioners confines his prayer to the extent of extending the period of surrender of the petitioners.

The matter has been placed in view of the administrative order of Hon'ble the Acting Chief Justice dated 6.4.2016 since the co-ordinate bench which had earlier granted anticipatory bail to the petitioners is not available due to medical exigencies.

Patna High Court Cr.Misc. No.13932 of 2016 (2) dt.07-04-2016 2/2 It is submitted by learned counsel for the petitioners that petitioner no. 1 Md. Ekram alias Md. Ekramulhaq has already been arrested, hence this application on his behalf has become infructuous.

Petitioner nos. 2 to 5 being mother, maternal uncle and sister of the husband of the complainant were granted anticipatory bail in Complaint Case No. 361 of 2015 but the petitioners could not surrender.

On the grounds mentioned in the modification application, let the period of surrender of petitioner nos. 2 to 5 be extended further for a period of four weeks from the date of receipt/production of a copy of this order.

The order dated 10.11.2015 passed in Cr. Misc. No. 42639 of 2015 stands modified to the extent indicated above. Accordingly, the modification application is disposed of in connection with Complaint Case No. 361 of 2015 pending in the court of the learned JM Ist Class, Gopalganj.
