The petitioner seeks bail in connection with Kateya P.S. Case No. 240 of 2017 for the offences punishable under Sections 461/379 of the Indian Penal Code. The allegation is regarding unknown persons having committed theft in the temple resulting in 65 idols having been found missing.
The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor any evidence has come during the course of investigation to implicate the petitioner with the alleged crime except the fact that the spy of the police has disclosed about the complicity of the petitioner herein. It is further submitted that though the petitioner is accused
Patna High Court Cr.Misc. No.32226 of 2018 (3) dt.19-07-2018 2/2 in one other case but he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 24.10.2017 and a similarly situated co-accused person has already been granted bail by an order dated 30.05.2018 passed in Criminal Misc. No. 28331 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Kateya P.S. Case No. 240 of 2017.
