The petitioner is accused in connection with Bajpatti P.S. Case No. 120 of 2009 registered under Sections 409 and 420 the Indian Penal Code.
The accusation is that petitioner, being the Panchayat Secretary of Gram Panchayat, Bajpatti of village Patdora, was found absent in four weekly meetings of Janta Darwar and also did not return the remaining coupons of kerosene oil and B.P.L Card, etc., as a result of which the District Magistrate lodged the F.I.R. against the petitioner.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.49489 of 2014 (2) dt.09-04-2015 2/2 submits that petitioner has falsely been implication in this case due to enmity. It is also submitted that the petitioner could not attend the meeting due to illness. In this case, the Police after investigation submitted the final form and S.D.J.M. took cognizance against the petitioner under Sections 409 and 420 of the I.P.C.
Considering the aforesaid submissions, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupari, District -Sitamarhi in connection with Bajpatti P.S. Case No.120of 2009, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.) Shail/- U
