The petitioners apprehend arrest in Azimabad P.S. Case No. 69 of 2014, registered for the offence punishable under Sections 341,323,448,504,506 and 34 of the Indian Penal Code and 3/4 of the Witch Craft (Prevention) Act.
The informant made allegations that the petitioners assaulted her and called her witch.
Learned counsel for the petitioners submits that on account of enmity, the informant lodged the case. Petitioners are co-sharer of the informant. The occurrence is said to have taken place on 25.10.2014 but the FIR was lodged on 14.11.2014. Considering the facts that the petitioners are co-sharer and after three weeks of the occurrence the informant lodged the case
Patna High Court Cr.Misc. No.6322 of 2015 (2) dt.16-02-2015 2/2 in the police station, the petitioners, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Ara in connection Azimabad P.S. Case No. 69 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) Prakash/- U T
