JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2019 As jointly prayed, since the order impugned dated 23.10.2018 passed by the Commissioner, Tirhut Division, Muzaffarpur in Arms Appeal Case No. 57 of 2018, has not been passed on merits but the appeal of the petitioner has been rejected on the ground of appeal being barred by limitation, I deem it fit and proper to quash the order dated 23.10.2018 passed in Arms Appeal Case No. 57 of 2018 and remand the matter back to the Commissioner, Tirhut Division, Muzaffarpur to pass a reasoned and speaking order on merits after hearing the petitioner herein or his authorized representative/advocate. The writ petition stands allowed to the aforesaid extent.
