JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Baheri Police Station Case No. 284 of 2014 registered for the offences punishable under Sections 147, 148, 149, 448, 452, 506, 353, 427 and 504 of the Indian Penal Code.
Petitioner is named in the first information report but as a matter of fact, he as well as some others including F.I.R named accused Rajesh Ram raised voice against illegal activities of the concerned B.D.O and thereafter, the concerned B.D.O lodged this case.
It is contended on behalf of the petitioner that accused Rajesh Ram has also made complain against the concerned B.D.O
Patna High Court Cr.Misc. No.8351 of 2015 (2) dt.03-03-2015 2/2 and the said complain is being inquired by the Commissioner of Darbhanga Division.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Baheri Police Station Case No. 284 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
