This application, for grant of anticipatory bail, arises out of SC/ST (Bhojpur) P.S.Case No.40 of 2015, disclosing offences under Sections 341, 323, 504, 467, 468, 120(B), 420 and 34 of the Indian Penal Code and Section 3(i)(x)(iv) of the SC/ST Act.
Learned counsel for the petitioner brought to my notice order of this Court passed in Cr.Misc.No.4949 of 2016 dated 17.03.2016 by which similarly circumstanced co-accused Birendra Prasad Yadav has been granted anticipatory bail.
Considering the submission that the case of the petitioner stands on similar footing, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.13983 of 2016 (2) dt.11-04-2016 satisfaction of learned ADJ-Ist, Bhojpur at Ara, in connection with SC/ST P.S.Case No.40 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
