This application for regular bail in connection with S.T. No. 257 of 2019, arises out of Buxar Muffasil P.S. Case No. 360 of 2018, disclosing offence punishable under Section 392 of the Indian Penal Code.
Learned Senior Counsel appearing on behalf of the petitioner has submitted that long incarceration of the petitioner in custody itself is a valid ground for renewal of the prayer for grant of regular bail. He has also drawn my attention to the orders passed by this Court dated 16.05.2019 in Cr. Misc. No. 32550 of 2019 and 01.05.2019 in Cr. Misc. No. 28238 of 2019,
Patna High Court CR. MISC. No.60593 of 2021(2) dt.01-12-2021 2/2 whereby other co-accused persons have been allowed regular bail. He contends that confessional statement of the petitioner is the only material collected during course of investigation and no other incriminating material has been collected against him. Considering the above submission and the facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J-IX, Buxar in S.T. No. 257 of 2019, arises out of Buxar Muffasil P.S. Case No. 360 of 2018.
