Petitioner seeks bail in Musahri P.S.Case No. 113 of 2021 registered for the offences punishable under Sections 25(1b)a,26,35 of the Arms Act and section 20/22 of the NDPS Act. One country made pistol five live cartridges, one misfired cartridge and 150 gm substance like Charas were recovered from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Recovered Charas is less than commercial quantity. Petitioner has got clean antecedent and he is in custody since 05.07.2021. Investigation is complete.

Patna High Court CR. MISC. No.61333 of 2021(2) dt.14-02-2022 2/2 Learned APP for the State opposed the bail and submitted that name than small quantity of Charas has been recovered from possession of this petitioner. Considering the aforesaid facts and circumstances, the prayer for bail is rejected. However, once charge is framed and trial commences, the trial court is directed to release the petitioner on bail.
