Patna High Court CWJC No.10968 of 2023(2) dt.09-08-2023 2/3 direction(s) quashing the Gyapank no. 2935 dated 22.6.21 to the extent that it provided a ward member (peoples' representative) to act as a long term maintainer and also in case he refuses to do so then ward Sasha can appoint ward secretary (peoples' representative) as a long term maintainer. (II). For directing the respondents concerned not to make appointments on the post of long term maintainer by terminating the earlier appointments of the petitioners which were legally made in pursuance of para 6 (5) of the Gyapank No. 1153 dated 13.2.2019.

(III). For further directing the respondents concerned to reinstate the petitioners on the post of long term maintainer to run the tap water into the houses of the said wards under Mukhyamantri Har Ghar Nal Jal Yojana.

(IV). For further directing the respondents concerned to pay the monthly retainer fees fixed under the said Yojana for the work done by the petitioners from the date of their appointments to the date of their illegal termination (V). For further directing the respondents concerned to terminate the ward member of ward secretary appointed as a long term maintainer after terminating the petitioners in pursuance of Gyapank no. 2935 dated 22.6.2021."

After some arguments, the learned counsel for the

Patna High Court CWJC No.10968 of 2023(2) dt.09-08-2023 3/3 petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
