Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 409, 420, 467, 468, 471 IPC. Allegation against the petitioner is of tampering the register of C.P.C. Branch and of transferring the amount in the account of his known persons, after creating bogus, mature and Lapse policy.

He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. It is submitted by learned counsel for the petitioner that petitioner has already deposited Rs.9,30,400/- before the institution of the F.I.R. and the interest and penal interest of Rs.1,36,696/- has also been deposited. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, since the defalcated amount has been deposited, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Motihari Town P.S. Case No.492 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
