JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 02-02-2015 Heard learned counsel for the petitioner and AC to GP17 for the State. Counsel for the petitioner submits that the matter may be disposed of at this stage itself by directing the respondent- Circle Officer, Triveniganj to dispose of Mutation case no. 168 of 2004-05 in respect of the petitioner. It appears that by order dated 25.10.2004 the Circle Officer decided the matter against some of the persons. Four of the aggrieved persons filed appeal thereagainst vide appeal no. 27 of 2012-13. The appeal was considered and disposed of whereby the order in respect of the petitioner passed in Mutation case no. 168/2004-05 was quashed and set aside and the same was remanded for fresh consideration and adjudication by the Circle

Patna High Court CWJC No.21082 of 2014 dt.02-02-2015 2/2 Officer in the light of the direction contained therein. One of the appellants of appeal no. 27 of 2012-13 has filed the present appeal raising a grievance that the mutation case pending on the file of the respondent- Circle Officer after remand has not been disposed of till date. It has, therefore, been submitted that the application be disposed of directing the Circle Officer to comply with the order passed by the Deputy Collector Land Reforms, Triveniganj (Supaul) in appeal no. 27/2012-13.Considering the limited prayer made in the writ application learned counsel for the State has agreed for final disposal of the case at this stage.

Having heard the parties, the writ application is disposed of by directing the Circle Officer (respondent no.4) to dispose of the Mutation case no. 168 of 2004-05 respecting the petitioner, if not already disposed of, in accordance with law and the directions contained in order dated 30.04.2013 passed in appeal no. 27 of 2012-13 as quickly as possible preferably within three months from the date of receipt/production of a copy of this order.
