The petitioners apprehend their arrest in Jalalgarh P.S. Case No. 117 of 2021, registered for the offences punishable under Section 379 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that all the six FIR named accused persons including this petitioner are alleged to have assaulted the informant with lathi and Spade, as a result of which he sustained injury on his head and hand. It is submitted that there is general and omnibus

Patna High Court CR. MISC. No.61124 of 2021(2) dt.11-07-2022 2/2 allegation of assault against all the accused persons and no specific overt act has been alleged against petitioners. Injuries have been found to be simple in nature. The alleged Marpit took place due to land dispute between the parties. Petitioners have got clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 117 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
