The petitioner, already in custody, seeks bail in connection with Sonepur (Hajipur) Rail P.S.Case No. 52 of 2017 registered under Section 379 of the Indian penal Code. Learned counsel for the petitioner submits that case of theft of motorcycle is against unknown, however, motorcycle was recovered from possession of one Md. Sajjad and not from the petitioner and he has been falsely implicated stating that motorcycle was sold by the petitioner and has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Bittu Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM(Railway), Sonepur at Sasaram in connection with
