This application, for grant of anticipatory bail, arises out of Dumariyaghat Police Station Case No. 08 of 2019, disclosing offences under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act. As per FIR, the Sub Inspector of Police arrested coaccused Abhishek Kumar and from whose possession a motorcycle and country-made pistol of point 315 bore with two live cartridges were recovered. The learned counsel for the petitioner has submitted that the petitioner was not arrested on the spot and his name was figured only in confessional statement of co-accused. Learned Addl. P.P. has opposed the prayer for anticipatory bail.

From perusal of para 3 of the bail application, it appears that as many as four cases of similar nature are pending against the petitioner which reveals that serious criminal antecedent. As such, it is not a fit case for anticipatory bail. Accordingly, the prayer for anticipatory bail of this petitioner is hereby rejected.
