The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken case registered for the offences punishable under Section 376 of the Indian Penal Code. It is alleged that the petitioner established physical relationship with the informant on promise of marriage but subsequently, dowry of Rs.1,50,000/- was demanded and the marriage was not performed.

It is submitted by learned counsel for the petitioner that the police after investigation found the accusation under Section 376 of the Indian Penal Code false. The medical opinion also did not corroborate the accusation and

Patna High Court Cr.Misc. No.12857 of 2015 (2) dt.27-03-2015 2/2 subsequently on protest the cognizance has been taken. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Complaint Case No.2411 C of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
