The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioner is named in the FIR and he is alleged to have assaulted Mahanth Sahni with Farsa on his head. It is submitted that Title Suit No. 82/ 2014 is pending between the parties in the court of Munisf, Bettiah, West Champaran and the petitioner has already filed Nautan Jagdeeshpur P.S. case No. 420 of 2015 as the informant and others brutally assaulted the wife of the petitioner when she had gone to participate in the Panchayati but from perusal of the records, it appears that there is very specific allegation against the petitioner

Patna High Court Cr.Misc. No.15336 of 2016 (2) dt.25-04-2016 2/2 that he assaulted with Farsa on head causing grievous injury on the head of Mahanth Sahni, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
