Petitioner apprehends arrest in connection with Bihta P.S. Case No. 537 of 2020 registered for the offence punishable under sections 420, 379, 411 of the Indian Penal Code and section 11/56 of the Bihar Minerals (Concession illegal Mining, Transportation and Storage) Rule 2019.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on basis of suspicion. Petitioner is not the owner of the poclain machine which was seized near the river bank. Petitioner is a retired employee of Bihar Regiment.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, I, Danapur in connection with Bihta P.S. Case No. 537 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
