JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Silao P.S. Case No. 94 of 2019, disclosing offences under Sections 341, 323, 307, 504, 34 of IPC. Prosecution story disclosed that petitioner threw dustbin in the house of informant, when the wife of the informant protested, she was abused and assaulted by him and when the informant came to save her, who has also assaulted by one Sanni Kumar and Nandlal Prasad. There is other allegation also against Sipu Devi of abuse and assault and torn her blouse. Further allegation against Rubi Devi of assault and snatched a golden chain from her neck and threw her by catching her hair. Submission of the learned counsel for the petitioner is that no specific allegation of assault is against the petitioner and there is general allegation of assault to the wife of the informant

Patna High Court CR. MISC. No.48699 of 2019(2) dt.05-08-2019 2/2 and the injuries on the informant is simple in nature which will appear from Annexure 2 of this application.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Nalanda, at Biharsharif, in connection with Silao P.S. Case No. 94 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
