Petitioners are in custody in connection with Palanwa P.S. Case No. 33 of 2018 for offence under Sections 272, 273/34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel submits that petitioner has no criminal antecedent. He further submits that petitioner was not aware of the fact that the 10 litre liquor was kept in the dickey of the motorcycle that was not the petitioner's motorcycle but it belongs to other person. Petitioner is in custody since 17.04.2018.

Considering the totality of the fact and situation, let

Patna High Court Cr.Misc. No.33160 of 2018(2) dt.05-06-2018 2/2 the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned IV Additional Sessions Judge-cum-Special Judge Excise, East Champaran, Motihari in connection with Palanwa P.S. Case No. 33 of 2018.
