The petitioner is in custody since 23.01.2018 in connection with Ishipur Barahat P.S. Case No. 10 of 2018 registered for the offence under Sections 420 and 379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that save and except statement made by one Rohit Kumar Paswan, who was arrested from the place of occurrence, that the petitioner was also involved in the fraud of sale/purchase of Vodafone Sim card, which led to withdrawal of money from the account of the informant, there is no further material on record to implicate the petitioner in the present case. Patna High Court Cr.Misc. No.32962 of 2018 (3) dt.04-07-2018 further submits that the petitioner has got no criminal antecedent and that he is languishing in jail for no fault of his own. In view of the aforementioned facts and circumstances and the fact that the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- VIII, Bhagalpur in connection with Ishipur Barahat P.S. Case No. 10 of 2018 corresponding to G.R. No. 331 of 2018.
