Petitioner is in custody in connection with Aurangabad Town P.S. Case No. 129 of 2018 for offence under Section 30(a), 38(i) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel submits that petitioner is a poor labourer and he has been falsely implicated in this case. He has been made escape goat in this case. Learned counsel submits that the liquor was recovered from the land behind the hotel of Pritam Raj near bus depot. He is neither the owner of the hotel nor anyway connected with the seller and purchaser of liquor, which is prohibited.
Considering the fact that the petitioner has remained
Patna High Court Cr.Misc. No.33220 of 2018(2) dt.05-06-2018 2/2 in custody since 22.04.2018 and as per averments made in the petition that the petitioner is labour and not the owner of the hotel, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII-cum-Special Judge (Excise), Aurangabad in connection with Aurangabad Town P.S.
