This application for anticipatory bail arises out of Raniganj P.S. Case No. 336 of 2018, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code.
There is allegation against the persons named in the FIR of having assaulted the informant and others variously. It is alleged against the petitioner that he assaulted the informant's father with farsa in his head causing serious injury. Learned counsel appearing on behalf of the petitioner has submitted that the injury report of the informant's father falsifies the allegation made in the FIR, inasmuch as, the injury has been found to have been caused by hard and blunt
Patna High Court CR. MISC. No.48590 of 2019(2) dt.05-08-2019 2/2 substance. It has also been submitted that there is a counter-case also for the same occurrence.
Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Araria in Raniganj P.S. Case No. 336 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
