Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today. The petitioner seeks anticipatory bail in connection with Samastipur Mufasil P.S. Case No. 381 of 2018, registered for the offences under Sections 120-B, 34, 408, 409, 420, 465, 466, 468, 470, 471 and 477-A of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was posted in the KOT as Havildar during February, 2012 to 06.04.2015, while the enquiry was done in respect of the period from June, 2015 to May 2018 for the misappropriation of the
Patna High Court CR. MISC. No.60601 of 2021(2) dt.07-06-2022 2/2 firearms concerned. Considering the same situation, this court has granted anticipatory bail to the co-accused Bhola Prasad Choudhary @ Bhola Choudhary vide Criminal Miscellaneous No. 54249 of 2021. Petitioner has got no criminal antecedent. Having considered the above submissions and considering the fact that co-accused carrying similar allegation has been granted anticipatory bail by this Court vide Criminal Miscellaneous No. 54249 of 2021, let the above named petitioner in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Samastipur in connection with Samastipur Mufasil P.S. Case No. 381 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
