JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2021 Heard Sri Javed Aslam, learned counsel for the appellant and learned Special PP for the State. The present criminal appeal is directed against the order dated 13.11.2020 passed in ABP no. 2403/2020 by Ist Addl. Sessions Judge-cum- Special Judge, Siwan in connection with Hussainganj P.S. Case no. 54 of 2018 registered under sections 147, 148, 149, 341, 323, 337, 338, 307, 379, 295A 504 and 506 of the Indian Penal Code read with sections 3(i)(r)/3(2)(va) of SC/ST Act whereby anticipatory bail of the appellant has been rejected. Learned counsel for the appellant submits that appellant is a person with clean antecedent. He further submits that without going into the merit of the case, he

Learned Special PP does not oppose the submission of anticipatory bail of learned counsel for the appellant, in view of submission made by learned counsel for the appellant provided; the court below is directed to verify as to whether parties have entered into compromise or not. Considering the facts that parties have entered into compromise on account of intervention of well wishers, appellant is directed to surrender in the court below on 30.11.2021 when the appellant shall be released provisionally on anticipatory bail for a period of two months on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Ist Addl. Sessions Judge-cum- Special Judge, Siwan in connection with Hussainganj P.S. Case no. 54 of 2018 subject to the condition under section 438(2) Cr.P.C.

Simultaneously, the court below shall issue notice to the informant and in the event the court below is satisfied
