CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 21-08-2015 Heard learned counsel for the parties.

Counter affidavit has been filed on behalf of the respondent no. 6 in which the stand is that all admitted retiral dues to the petitioner pertaining to the Bihar Police Building Construction Corporation have been paid. However, from the pleadings, it appears that the petitioner had worked under the Jharkhand Police Housing Corporation Limited for certain periods with regard to which the payments relating to salary, G.P.F. etc. have to be borne by such Corporation. It further appears from the pleadings that the petitioner has not even made any representation to the concerned authorities in the State of Jharkhand. Attention of the Court has been drawn to order dated 22.10.2013 passed in C.W.J.C. No. 13800 of 2012 ( Ravindra Kumar vs. The State of Bihar) in which a co-ordinate Bench of this Court has also taken a similar view that for the purposes of payment of salary etc. for the period spent under the service of the Jharkhand Police Housing Corporation Limited, the liability to pay the said amount will be of that organization.

Patna High Court CWJC No.21150 of 2011 dt.21-08-2015 3/3 In view of the aforesaid, the writ application stands disposed off with liberty to the petitioner to file an appropriate representation before the Managing Director of the Jharkhand Police Housing Corporation Limited within six weeks from today along with a copy of this order. If such a representation is filed, the authority concerned shall ensure that all admissible dues of the petitioner, which may have remained unpaid, shall be paid to him within four weeks thereafter.
