2. The petitioners seek regular bail in connection with Bhimpur P.S. Case No. 23 of 2019, registered for the offence punishable under Sections 366A & 34 of the Indian Penal Code & later on Sections 4/6 of POCSO Act has been added.

3. As per prosecution, the petitioner has eloped with one Bimla Kumari who has been found to be major in her medical examination.

4. Learned counsel for the petitioner submits that the petitioner is innocent and have falsely been implicated in this case. Petitioner has got no criminal antecedent and he is in custody since 16.12.2022.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.52664 of 2023(2) dt.23-08-2023 2/2 for bail.

6. Considering the nature of allegation and also period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- 6th cum Special Judge, POCSO, Supaul in connection with Bhimpur P.S.
