The petitioner, already in custody, seeks bail in connection with Khagaria (M) P.S.Case No. 127 of 2018 registered under Sections 363 and 366A/34 of the Indian penal Code.

Allegation in brief is that petitioner enticed away the minor daughter of the informant.

Submission is that informant's daughter is, in fact, major and medical board has also found her age in between 15-17 years and it's a case of elopement and same is reflected from her statement recorded under Section 164 Cr.P.C.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Mithilesh Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the
