JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Kundwachainpur P.S. Case No. 32 of 2013, disclosing offences under Sections 363 and 365 of the Indian Penal Code. As per allegation against the petitioner in the First Information Report, it is specific to the extent that he had taken the informant's son to Delhi. Admittedly, the child has not yet been traced.

In such circumstance, I am not inclined to grant the privilege of anticipatory bail, despite the submission made on behalf of the petitioner that no further material has come against him in course of investigation because I am of the opinion that

Accordingly, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the court below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
