JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard Mr. Hriday Narayan Harshit, learned counsel for the petitioner and Mr. Ajay Mishra, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Rudrapur P.S. Case No. 52 of 2022 registered for the offences punishable under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code 1860.

As per the First Information Report, the petitioner has allegedly submitted forged marks-sheet of Intermediate at the time of his appointment for the post of Panchayat Teacher. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. He next submits

No.51532 of 2022(2) dt.09-12-2022 2/2 that at the time of appointment, the verification of certificate submitted by the petitioner was done but after 15 years, the same has been alleged to be forged document. The petitioner is in custody since 22.5.2022 and charge sheet has already been submitted.

Having heard learned counsel for the parties and taking into consideration the nature of allegation and the fact that the charge sheet has already been submitted, the petitioner is in custody since 22.5.2022 and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jhanjharpur, Distt. Madhubani, in connection with Rudrapur P.S. Case No. 52 of 2022.
