JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-11-2017 After some argument, learned counsel for the petitioner seeks permission to withdraw this application with a liberty to raise all such pleas which are available to the petitioner at the time of framing of charge.
Permission is granted.
The application is permitted to be withdrawn with the liberty aforesaid.
Before parting with this case, it would be relevant to note that the order taking cognizance in the present case was passed as far back as on 18.01.2006, the Court has been informed that the case is still pending at the same stage. It is difficult to understand as to why even during this 11 years of the period the
Patna High Court Cr.Misc. No.50056 of 2014 (2) dt.22-11-2017 court below has not proceeded with the case. The quashing application in this Court was filed in the year 2014 for setting aside the revisional order dated 26.04.2010. It shows that on the one hand, the petitioner has been moving the Court as and when he desires even after a long lapse of time and at the same time the court below is keeping the matter pending for no reason. In the circumstances, in the interest of justice, it is directed that the court below must proceed with the matter and conclude this case by taking it to a logical end within a period of six months from the date of receipt/production of a copy of this order.
