The petitioner seeks bail in connection with Rosera P.S. Case No. 112 of 2018 for the offences punishable under Sections 30(a), 37(A), 37(B) of the Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 69 liters of illicit liquor from a car and a motorcycle.

The learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said vehicles and in fact no recovery has been made from the conscious possession of the petitioner.

It is submitted that the petitioner is having a clean

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur in connection with Rosera P.S. Case No. 112 of 2018.
