The petitioner apprehends his arrest in Mashrak P.S. case No. 33/2015 under Section 420, 409/34 of the Indian Penal Code.
The petitioner was Branch Manager of Uttar Bihar Gramin Bank, Rajapatti, Saran. It is alleged that one Ravi Ranjan, Business Clerk, got Rs. 30,68,500/- credited in his account from the accounts of other customers.
It is submitted that the petitioner had no knowledge about the money credited in the account Ravi Ranjan. Ravi Ranjan has already been granted anticipatory bail by Sri Naimullah, the then learned 1st Additional Sessions Judge, Saran at Chapra, only on the ground that the amount of Rs. 30,68,500/- credited in the
Patna High Court Cr.Misc. No.15410 of 2016 (4) dt.18-07-2016 2/2 account of Ravi Ranjan has already been credited in the account of different customers. Of course, Ravi Ranjan played fraud but learned 1st Additional Sessions Judge without considering this fact granted anticipatory bail to Ravi Ranjan and case of petitioner is quite different as he was Branch Manager and there is nothing on record to show that petitioner had any contact with Ravi Ranjan. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri K. K. Tiwari, learned Judicial Magistrate, 1st class, Saran at Chapra in Mashrak P.S. Case No. 33 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
