Petitioner is in custody in connection with Bisfi P.S. Case No. 266 of 2017 for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and petitioner is in custody since 27.02.2018 and as such he has completed more than three months. He further submits that he was not main accused for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Considering the fact that the petitioner is remained in custody for more than three months and he has no criminal
