The petitioner apprehends his arrest in Karja P.S. Case No. 129 of 2014, registered for the offences punishable under Section 394 of the Indian Penal Code.

The informant was going to deposit money but three persons intercepted him and snatched his money, mobile, A.T.M. card, PAN card. On chase one Md. Ishteyaq was apprehended from his possession PAN card, A.T.M. card of the informant's were recovered. Md. Ishteyaq on being apprehended disclosed the name of the petitioner.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It has come during investigation that nothing was recovered from the possession of

Patna High Court Cr.Misc. No.5956 of 2015 (2) dt.13-02-2015 2/2 Md. Ishteyaq.

On perusal of records, it appears that Md. Ishteyaq was apprehended while he was fleeing away along with the petitioner after committing robbery and from possession of Md. Ishteyaq looted articles such as PAN card and A.T.M. card were recovered and Md. Ishteyaq disclosed the name of petitioner on the spot itself.

Considering the facts aforesaid I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
