ANJANA MISHRA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the Vigilance and learned counsel for the State.

The petitioner apprehends his arrest in connection with Bairagania P.S. Case No. 160 of 2015 for the offences registered under Sections 409, 467, 468, 471 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner had already deposited all the original certificates including the experience certificate to the Block Development Officer, Bairagania on 16.07.2015 itself in the light of the letter no. 205 dated 07.07.2015 issued under the signature of Block

Patna High Court Cr.Misc. No.15501 of 2016 (9) dt.23-11-2016 Development Officer, Bairagania. However, despite the same the present case was registered against the petitioner. Learned counsel for the Vigilance after perusal of the case diary submits that at paragraph -44 of the case diary such facts has come to the fore and, therefore, no case is made out against the petitioner.

Considering the aforesaid facts and circumstances of the case let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Bairgania P.S. Case No. 160 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
