JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, in the present case, is seeking regular bail in connection with Danapur P.S. Case No. 176 of 2018, registered for offences alleged under Section 379, 406, 411 of Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R, even though the allegation is that on the basis of the confessional statement recovery of Scorpio vehicle has been made but a perusal of the First Information report shows that the owner of the garage has specifically stated that the key of the vehicle was lying with 3 persons who are named in the F.I.R. Learned counsel for the petitioner submits that the petitioner

Learned A.P.P. for the State is present.

Considering the facts and circumstances whereunder the F.I.R discloses the name of the persons who were in possession of the keys of the vehicle in question and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M- I, Danapur, in connection with Danapur P.S.Case No. 176 of 2018, subject to the conditions that one of the bailors should be a family member of the petitioner having no criminal antecedent.
