Admittedly, except section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act, all sections are bailable in nature. The contention on behalf of the petitioners is that section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act is not applicable in this case because the present case has been lodged with mala fide intention as the daughter of petitioner no.1 was being teased by the informant's son and when petitioner no.1 made complain, informant lodged this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.8307 of 2015 (2) dt.03-03-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Munger in G.R. no. 98/2015 arising out of SC/ST P.S. Case no. 02/2015 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
