JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Chapra Town P.S. Case No. 198 of 2014 registered under Sections-419, 420, 379/34 of the Indian Penal Code. The petitioner is not named in the first information report but it has been averred at paragraphs-8 & 9 of the petition that on the basis of statement of spy of police, the name of the petitioner came in this case and after that, the son of the informant claimed to have seen the petitioner near ATM Booth between 2207-2014 to 24-07-2014 though the alleged occurrence took place on 11-07-2014.

From perusal of impugned order of learned Sessions

Patna High Court Cr.Misc. No.9436 of 2015 (2) dt.10-03-2015 2/2 Judge; it appears that there was no material before the learned Sessions Judge to show the involvement of the petitioner in the alleged crime.

Considering the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioner named-above, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chapra Town P.S. Case No. 198 of 2014 to the satisfaction of Chief Judicial Magistrate, Saran, Chapra subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
