JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.2.2018, seeks bail in Parwalpur PS Case No. 178 of 2017 registered under Sections 399, 402, 120B of the IPC and Section 25(1-B)a, 26 and 25 of the Arms Act.

The allegation in brief is that the police on secret information raided a lonely place, apprehended some of the miscreants engaged in making plan for committing dacoity and recovery of arms were made from few of them.

Learned Counsel for the petitioner submits that the petitioner was not apprehended on the spot, his name was disclosed by another co-accused there is no recovery of any arms or any other incriminating article from the petitioner's possession, he has no criminal antecedent except one case, other co-accused Rohit Kumar, Nitish Kumar Tulan Kumar from whose possession recovery of arms were made have been admitted to bail by this Court as well as by coordinate Bench of this Court and the petitioner is in custody since 8.2.2018.

Having considered the said facts and circumstances, the

Patna High Court Cr.Misc. No.34504 of 2018 (2) dt.28-06-2018 petitioner, namely, Chhote Lal Saw @ Chhotelal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Hilsa (Nalanda) in connection with Parwalpur PS Case No. 178 of 2017.
