The petitioners have preferred this application for grant of regular bail in a case registered under sections 30(a), 36 and 41(i) and (ii) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, the six accused persons including the two petitioners herein were caught and on search 2148.75 litres of liquor was recovered.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case because of their antecedents. No incriminating article has been recovered from their possession. They are in custody since 9.8.2021 and chargesheet has been submitted in the case. The application for bail is opposed by learned

Patna High Court CR. MISC. No.61922 of 2021(2) dt.12-04-2022 2/2 A.P.P. for the State who submits that the petitioner no.2 has an antecedent under the Bihar Prohibition and Excise Act, 2016. Having heard learned counsel for the parties and taking into consideration the facts of the case together with the antecedent of the petitioner no.2 under the Bihar Prohibition and Excise Act, 2016, the Court is not inclined to enlarge the petitioner no.2 on bail and the application is rejected. Liberty is granted to the petitioner no.2 to renew his prayer for bail after completing one year in custody. Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner no.

1 (Rajiv Ranjan @ Golu) not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner no.1 to be enlarged on bail in connection with Special Case no.4905 of 2021 (arising out of Maner P.S. Case no.580 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna.
