The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that 108 bags rice were recovered from the rice mill of Subhash Kumar @ Babloo namely M/s M.P. Ventures Private Limited, whereas 72 bags were seized from the truck being driven by the petitioner.

It is submitted by the learned counsel for the petitioner that petitioner was a bona fide driver and rice miller has claimed that there was some agreement of supply of rice between the rice miller and the B.S.F.C.

Considering the fact that thrust of accusation is

Patna High Court Cr.Misc. No.9624 of 2015 (2) dt.11-03-2015 against the rice miller, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur in connection with Maner P.S. Case No. 33 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
